Productivity

One of the recent headlines in Canada originated from a speech given, in fact it was termed a “blunt” speech, by the Sr. Deputy Governor of the Bank of Canada Carolyn Rogers. The speech centred around the drop of productivity in Canada in relation to other countries, in particular the U.S. and the G7. She described the weak labour productivity in Canada and said that in fact it had reached levels that should be considered an “emergency”.

Productivity in the economy is defined traditionally and measured in economic output per hour worked. In 1984 our Canadian levels were at 88% of that of the Americans, but in 2022 we are at 71% versus the Americans and we are lower than the G7 countries with the single exception of Italy. Again, the speech was one dealing with purely economic theory– productivity down, labour costs up, prices up, and the continued growth of inflation. However, this led to the question of whether or not productivity can be measured in policing or in the wider legal system.

Can labour and its level of efficiency be measured in policing, or at least to some degree? There is labour, there is time and there is an output, even though it is not an economic output? Can it be as simple as a calculation such as number of officers up, crime up, therefore police productivity down? Public Safety Canada does not even use the term productivity. So it can probably be assumed that currently there is no measure of “productivity” in terms of individual officers, or as officers in terms of a particular unit. Public Safety Canada and other police agencies, instead use the term “performance”.

There are two major differences in productivity versus performance . Performance is both qualitative and quantitative while productivity measures the impact or output of the work done and the labour resources employed.

The Federal government indicates that there are both direct and indirect measures of “performance” in relation to policing. They say direct measures are such things as crime rates, number of arrests, fines issued, clearance rates, and calls for service response times. They say “indirect” measures include, surveys, observations of social behaviour, situational studies and independent testing. I am going to ignore the latter measurement tools, the indirect tools, because it would seem to be a much more subjective set of tools and would be a lengthy topic all on its own.

In terms of direct measurement tools, there are some units in policing which are easily measured such as calls into a dispatch centre. For instance, they measure time response in answering emergency 911 calls. In the last stats reported by E-Comm , it was on average 5 seconds or less. This despite there having been an 11% increase in calls for service. A good result, with a positive spin. On the other hand they do not measure how long a non-emergency call takes; such as reporting a break and enter, or how long that person may wait on hold under those circumstances. Nor do they give statistics on how long before an officer even attends a break and enter, in fact in the cities, they may not even attend– often telling the victim to send in the details. This is just to say, measurement tools can be flawed, in-complete or mis-leading and can often be tailored depending on your viewpoint. But the fact that there are some measurements in place in terms of performance is re-assuring.

In a different example, in September 2023 report done for Police Services concerning the CFSEU (Combined Forces Special Enforcement Unit) was obtained by a freedom of information request by the Vancouver Sun newspaper. In that report the agency came under heavy criticism. In the 123 page report it was stated that the agency “is neither effective in suppressing gang violence and organized crime nor is it providing the Province with an adequate return on investment”. A damning statement but what seemed more interesting is that they clearly undertook what must have made some cost/benefit analysis of the work being done by CFSEU– and clearly found it wanting. The report had been undertaken after a spate of murders, such as the one at Vancouver International Airport, and the shooting of Tequel Willis, who was only 14 but already a member of the Brothers Keepers. At the time and with the required concern expressed with this increase in blatant and brazen murders, they announced the launch of “Operation Spectrum”.

The review however, found that Spectrum operation “had no investigative component and only amounted to increased intelligence sharing between agencies” and that the entire project “fell short”. The report went further and said that “there are issues with CFSEU’s leadership and senior management model…and…a lack of continuity in policies and procedures”. They even added that their mandate wasn’t even clear. This is no small unit, there are 440 officers assigned to CFSEU, and they have an annual budget of about $90 million and are primarily responsible for gang activity in British Columbia. It is a large unit that according to this study were vastly under performing.

The CFSEU managers when questioned by the media weakly replied that they had not received a copy of the report. Is it possible that Police Services had this report, and were simply hanging on to it, and never felt the need to act on it? For the record the agency has been led since 2021 by A/Commissioner Manny Mann, who by default also oversees the Organized Crime Agency. One would have thought that there would have been some sort of repercussions coming from this report which was issued back in September 2023, when the questions were clearly pointing at the lack of performance, productivity and the eventual measured outcomes. As this is being written, so far nothing has been done and there has been no public accounting or explanation offered by the RCMP upper levels, who must have got a copy of the report by now.

Is this a measurement of the individual members of CFSEU? Not really, we can not draw that conclusion. Most everyone who has some insight into this unit knows that there are members of this unit who are hard-working, spending countless thankless hours and many night shifts trying to keep tabs on some of the many gangsters who run about this Province. That being said we also know that there are some members in that unit and other government units, who have their feet up, enjoy the overtime, and dream of a lucrative retirement. Let’s face it, every agency has the players of the system, the ones who are around for a free ride, the officers always being the “backup” car to keep away from the paperwork, and those that don’t simply like to leave the office.

We also know that the hard workers, the often quiet ones who toil away and make little fuss often go unrewarded. Promotion is “allegedly” based on performance, yet time and time again a great many of the laggers still find their way up the chain of command. One often is forced to the conclusion that performance is not being measured accurately or with any consistency.

Another complexity to any kind of measurement is the fact that there are many officers doing many different jobs sometimes inside the same unit, with different skill sets and different mandates and efficiencies. How do you measure a group who write warrant applications with another group that spend the majority of their time doing surveillance, or others who may be doing strictly administrative jobs.

Individually, every year every officer of the RCMP is subject to a Performance Review. It is assumed that municipal agencies have some similar process. In the RCMP the immediate supervisor outlines the good and the bad of the individual sitting before them. It is completely subjective and therefore often falls prey to individual likes or dislikes. Every supervisor also wishes to keep their charges happy, especially in this age of victims and apparent unlimited stress leaves, so inevitably these annual documents are positive. They are also rather lengthy documents and every supervisor dreads having to complete them. I have seen and heard many supervisors tell their underlings to write their own document and they will just sign it. Measuring performance in this atmosphere and style is clearly problematic and many would consider it as a form of process an abject failure, yet it has survived for decades.

Then consider the unlimited numbers of sections in the RCMP and to a lesser extent the municipal agencies, and how does one compare performance or productivity between all of the various Provinces and specialties. How does one measure the productivity or performance of someone on the Musical ride, or in Media relations, and how would you compare it with someone in uniform answering calls in Prince George or in Bella Bella or in London, Ontario. The pay structure however is uniform. All of the same rank make the same salary regardless of the unit, or the importance of that unit to the overall policing mandate. Performance or productivity does not factor in to how much one is paid. One can easily see the problem and the level of complexity. It is just as hard to find any willingness or intent to change it, or even make an attempt to measure it.

Public Safety as stated earlier, for the most part simply report on performance, they do not act or comment on those performance measures. They do direct measurements through such tools as the CSI (Crime Severity Index). If we glance at those statistics, the CSI was up 4% in 2022 the highest since 2007. Violent CSI, a different index also rose, with Robbery up 15%, Extortion up 39%, Homicide up 8% and sex assault up 3%. Non-violent CSI which applies to such crimes such as property theft is also up 4% and motor vehicle theft is up 24%.

The “volume of crime” index shows an increase of 5% to 5,668 incidents per 100,000 population. In any view, these statistics do not seem to lead one to believe that performance in policing is on the upswing, in fact it would be easier to assume that they are in fact trending negatively. However, there is no real accountability, except when for some reason a light is shone on one particular problem. In Ontario recently it is high end car thefts. An officer at a community meeting gathered some unwanted attention when he recently suggested that the public keep their keys by the front door to limit the damage from home invaders trying to steal keys. The message seemed to be, we can’t catch them so it is up to the public to limit them. Not the best statement if one were talking about trying to measure performance.

The usual answer you get when police executives face these poor numbers is to always go to the standard answer of it being due to dwindling resources, not a poor performance. In that, there is some but limited truth. In May of these same years, there were 70,566 officers, 406 more than in 2021– but still representing a 1% decrease, largely due to growth in population. Does a 1% decrease in resourcing explain the reason for what most would consider a poor performance?

This blog has always maintained that productivity and performance of units needs to be measured. In this age of sophisticated and minute data collection, one would hope that it is becoming increasingly possible and at some point there would be some attempts made to judge efficiency. It would seem key to having any viable and fully functioning organization. It also seems more necessary now than in past years to have some form of cost benefit measuring tool. There are many problems currently facing policing, but this should be considered one of the major issues, along with the need for much greater transparency. It has been plaguing policing for decades and at present, disappointingly there is no indication that they are yet willing to consider change and truly embrace the constant call for modernization.

Fall Reflections…

Writers and poets have spent many words in trying to capture the essence of the coming of Autumn. As nature changes to reflect the shortening of sunlight and what Keats called “the season of mist and and mellow fruitfulness”, for me it is a time to pause, a lull in time when we all re-adjust and prepare for a return to the comfortable routines. It is a favourite time for many, these days of changing colours, when the sky seems bluer, the clearer air markedly cooler. In nature, it is also a time of decay, a coming to the natural end of life. So it seems as good as time as any to reflect on the good and the not so good which have come out of these last few months. They are subjective, in no particular order, and of no particular importance.

One of my over-riding thoughts is about our news, the constant stream, less and less from traditional media, as the digression to a reliance on social media seems to be accelerating at an alarming rate. Thus, the reliability of that watered down news should be of the utmost concern. This is not new, this trend has been going for several years and it is indeed worrisome, especially for anyone who historically has valued the role of the 5th Estate. The news now is in snippets, pieces of video, pieces of conversation, mixed in with fully partisan and fragmented opinions. Press releases are being issued, and then regurgitated through the media in tiny sound bites to a public, which has clearly become disenchanted, and that disinterest is palatable. Every story is purposely planned to begin with “unprecedented”, “historic” and “never seen before”. It is like television and radio have been swallowed up by the National Enquirer. This summer as we took in the sunshine and communed with nature, our phones were constantly being pinged and alerted; bombarded by the news of “soaring inflation”, “unprecedented wildfires”, and the “historic cost of housing”. Youtube video and Instagram posts are now spliced into to be part of the actual coverage, and often polarized opinion is dangerously assumed to be fact. This trend is only disturbing if one values a functioning democracy, and therefore the need for an informed populace. One wonders whether we, the consumers, who seem addicted to instant scrolling gratification are also the problem or have we just been trained?

As one reflects on the political waves of the last few months, there does seem to be a swinging of the left/ right pendulum. Has the leftist arc of the pendulum reached its pinnacle, and is it now moving back? For sure, the Federal Liberals are coming to realize that things are not quite as rosy for their fatuous leader as they originally thought. So, in recent days they have been frantically swinging their arms in a desperate effort to fan the flames of fear, the fear over those evil right wingers marching over the horizon to destroy all the good they have created.

Pierre Polivere, the Conservative opposition, has executed a dapper change in his haberdashery from Clark Kent to Superman, and is finally feeding with some effect on the overt stupidity of recent Liberal pronouncements. His biggest concern may be that he is peaking a little too soon, as the election is still a couple of years away.

That said it does seem like we are adopting the American version of an election in which the campaigning starts at least two years in advance. This will mean that we will be very sick and very tired of hearing from any of the politicians with their dumbed down commercials filled with statements of progress and diversity, of being “there for you”, “going forward” and “working together”. For her part Deputy Prime Minister Chrystia Freeland, who has cut some of her television cable to account for the rough financial times, will continue to stand behind Justin, and nod with vigour at every statement he makes. The flame proof Bill Blair having survived being tied to Commissioner Brenda Lucki, will try and remain hidden in his new job as Minister of National Defence. Foreign Minister Melanie Joly will continue to have her minions prepare for the unforgivable possibility of a Republican being elected in the United States; as she also “revamps” her department to make it a nice place to work. The Governor General will continue to distribute her valuable wisdom and insights to anyone who will invite her to an exotic locale, and will arrive with her twenty plus entourage in tow, but sadly will only be able to offer and provide box lunches on any future flights.

Locally, the domestic theatre of the absurd politics in Surrey continues, and Mayor Brenda Locke keeps on with her obfuscation and attempt to prolong any transition to the Surrey Police Service. Brenda it would seem simply does not want to admit defeat. Meanwhile, it is costing the Surrey taxpayers $8 million a month currently for the present state of policing, but Ms. Locke will continue to tell everyone she is concerned about future policing costs. She continues to blame the Provincial government and it would seem that most of the most recent delay is because most government workers decided to take the summer off. Apparently losing $8 million a month and getting a functioning police force in place is not enough reason to postpone anyone’s holidays.

And do you remember the campaign by the Surrey Mounties and the Mountie union, the National Police Federation, where they detailed how they were the better persons for the job, and that future staffing was not an issue? This while recently we have been watching the current Commissioner Duheme touring the rural areas of Saskatchewan, and hearing story after story from his own members on the lack of staffing and the inability to do the job. The irony is overwhelming. Duheme is even saying now that there is “a recruitment crisis” and the Mounties are now at a “cross roads” in terms of their survival in their present form. So who was lying, the present Mounties in charge in Surrey or the current Commissioner?

The Federal Mounties it seems, still have not figured it out why no one is applying for their department. They now believe that to increase recruitment, the solution will be to further lower the standards. The head of the RCMP in Saskatchewan is Rhonda Blackmore. Ms Blackmore and the brass heading the Saskatchewan RCMP have now created the Saskatchewan RCMP Indigenous Recruiting Unit; who among other things recently sponsored a three day event to recruit indigenous candidates, give them tours of Regina, and were there to “help them fill out the application forms.”

Meanwhile the Feds in RCMP Ottawa, the dreamland capital, are debating reducing the time away from the use of marihuana, before working as a police officer, down to 24 hours– from the current 28 days. By putting scientific evidence aside, there belief is that would then be able to attract those daily doobie smoking future recruits who also have an interest in crime fighting.

Here is a reflective thought. How about they try and attract future police by making the RCMP a viable and expert policing organization once again? It will take longer, it is definitely not an overnight solution, but it will work.

Unfortunately, over the last few weeks and months we continue see the baleagured and beseiged Mounties being thrown to the wolves. The most recent slap in the face was the 123 page report commissioned by the B.C. Public Safety Ministry which stated that Combined Forces Special Enforcement Unit, a group of over 440 officers with a budget of over $90 million “is neither effective in suppressing gang violence and organized crime nor is it providing the Province with an adequate return on investment”. They described it’s governance as a “tangle of organizations…” that its “funding is unstable”…and that there is a “lack of continuity”…and “high rates of turnover”. The RCMP response to this damning indictment on September 8 for this report that was issued on April 16th, was that they had not yet received a copy of the report. Can anyone imagine a private company or even a government department getting this kind of review and no one being held accountable? The head of CFSEU, RCMP Assistant Commissioner Manny Mann is saying nothing, so one can only hope that he is busy preparing his retirement papers.

Further to the RCMP in Saskatchewan, in the past few months it was also announced that they will be holding two inquiries. The first is the inquiry into the eleven individuals stabbed to death on the James Smith Cree Nation. There is little doubt that it will be comparable to the inquiry in Nova Scotia over the Portapique mass murders in terms of the eventual criticism and the conclusions that will be reached.

It was also in Saskatchewan that the Province is now forming a 70 person Marshall service to deal with property crime at the cost of $20 million, to supplant the lack of attention to rural property crime from the RCMP. It has not been a good time in Saskatchewan lately and it looks like they will be front and centre in the next few months.

So as we have reflected, have we learned? Not really. There seems to be a lot of sameness and it seems that the culprits of the past few months, will be the culprits of the next few months. The problems of the past are ongoing and will continue, the solutions proposed in the past, likely will be the solutions proposed for the future.

I wish I could offer more solace, but at least we took the time to reflect and take a deep breath.

Personally, I am looking forward to the Fall, but mainly because I love baseball– and there is nothing like October baseball.

Small Dutch boy needed…

There are a lot of analogies that would seem to fit the current state of bedlam in Surrey, that bastion of the Royal Canadian Mounted Police efforts in municipal policing, their veritable flagship of contract policing. Mary Mapes Dodge in her story of “Hans Brinker; or the Silver Skates” wrote about the little Dutch boy who saved his country from disaster, by plugging a finger in the dike until help arrived the next day. It seems to be a fitting description of Surrey and the RCMP– in light of the back and forth bureaucratic political maelstrom now taking place in that fair city while also reflecting the current overall state of Canada’s national police force.

Of course in this metaphorical dike there is more than a single hole, there are many, all of which are being plugged by the fingers of the likes of Assistant Commissioner Brian Edwards, Assistant Commissioner Manny Mann, and Chief Superintendent Sean Gill. Playing the Dutch Queen, is the the illustrious and apparent policing expert Brenda Locke who is of course, now the mayor of Surrey with her 28% of the popular vote versus 27.3% of the popular vote for Doug McCallum.

Her lacklustre .7% win did not deter her from giving the speech about the “people have spoken”. Brenda Locke to keep her promise is willing to pay out over $100 million of taxpayer dollars to go back to the status quo of keeping the Mounties. (Did we mention that she used to be a party supporter of McCallum when he originally made it an election issue for a separate police force). She fell out of McCallum’s favour though and then switched her position. This all seems to be more about political revenge than thought out policy. In any event it has come about that on November 29th, Locke and her new group of councillors voting 5-4, have now endorsed the “framework for a development of a plan” to undo what has been done. This was after a presentation by A/Comm Edwards to the City council wherein he talked about what a great job the Mounties are doing and will continue to do when they get rid of those nasty Surrey Police Service upstarts, which by the way are now a few hundred members strong. A “Project Team” will oversee a development of this plan, that will need to be submitted to city council by December 12, 2022– which in turn would need to be forwarded to the BC Solicitor General and the Public Safety Minister for approval. Of course new Premier Eby will have a final say, one way or another.

One must keep in mind that the transition to a City Police Service has already been approved by all three levels of government.

For the BC Police Services and the Ministers to reverse that original McCallum majority government led initiative, one would think will take some real persuasion. Locke must realize that it is a high hill to climb so she has tried to stack her Project Team by hiring Dr. Peter German (clearly someone who has the ear of Premier Eby who had hired German when he was looking into money laundering and the casinos) and Tonia Enger (a self-declared “contract policing expert”). Both of course are former RCMP officers of lengthy service, and one would have to assume that their report will now have to be supportive of a return to the RCMP, and somehow also make it seem logical. Expect to see the money issue down-played.

The RCMP and their union, the National Police Federation, have been strident and vocal supporters of Locke to oppose McCallum, the Darth Vader of Surrey politics. I have been told on good authority that at the election headquarters for Locke on the night of the vote, Edwards, Mann and Gill were there in full glory, exhorting and cheering on their new mayoral hero. So much for police being politically impartial.

Then there was the curious case of public mischief brought against the Mayor, of which he was acquitted, much to the Mountie chagrin. What was curious about the case was that McCallum made a complaint of assault, and within a few days, he himself was charged with public mischief. The whole case should never have gone forward, but that aside, there is something highly suspicious about the Mounties bringing charges against McCallum in the first place, and in such a quick turnaround. Now, with little doubt, the City will also have to pick up McCallum’s very pricey legal bills.

There is also a ground level war going on between the Mounties and those that wish to replace them. The Mountie union for their part, will also be sending a report to the government with their view of the situation. The NPF spokesman, Ryan Buhrig, made an interesting comment to the press, in that he stated that seven of the fourteen “shifts” were currently “below minimum staffing levels”. Is this to blame on the transition, or is he admitting that the RCMP is currently not able to meet the contract needs? There is little doubt that these shifts were “below minimum” long before the Surrey Police Service came into existence.

I have by now heard from uniform officers from both sides. The RCMP officers I have spoken with make no bones about the fact that they don’t like the SPS officers, and the SPS officers in turn have complained about the brutal way they have been treated. Safe to say, the situation, morale wise is not good. I heard on high authority that the government at one time seriously considered making a formal complaint to the Public Complaints commission about the actions of some of the RCMP top management in their efforts to block the SPS. Their brief consideration was that the level of obstruction amounted to a form of “corruption”. They did not follow up for obvious political reasons.

If one wants to judge what the best course of action would be, there is a clear need to step back from the infantile actions of the politicians and senior police managers. One needs to look at this from the practical viewpoint and step away from the misinformation campaigns and the biased and often ignorant rhetoric. Let’s even forget about the monies spent, the monies about to be spent, or the monies about to be lost. The most basic decision and central question is whether or not the RCMP are even still capable of municipal and contract policing.

In the rest of the country, in academic circles, and even in the Federal RCMP rarefied air of Ottawa there is a very different dialogue going on. If contract policing is the dike then the holes in the dike, the holes in the organizational structure, are becoming increasingly apparent and they are numerous. The solution that is being discussed, proffered and debated is whether or not the time has come to let the dike break and in effect let the RCMP to get out of “contract policing”.

The most recent example is in an essay by Kevin Lynch and Jim Mitchell. Lynch is a former clerk of the Privy Council Office, and is now with BMO Financial; Mitchell is an adjunct professor at Carleton University. The paper got the attention of the Globe and Mail and is adding to the further discussion of this possibility. In the paper they argue that the problems of the RCMP are large in scope and that “they are inherently structural, requiring fundamental change to re-shape”. The Mountie “jumble of accountabilities” is supported by an “organizational model that fails them” and that they are “poorly positioned to discharge their responsibilities”.

Of course this is just the latest, in 2007 the Task Force on Governance and Cultural Change in the RCMP, stated that there was a requirement for a “much higher degree of managerial competence and sophistication than that which is currently found in the RCMP”. The Bastarache report said that the “culture is toxic, misogynistic, and homophobic”. In July 2022 an all party committee of the BC Legislature was tasked with reviewing the Police Act for the Province, stated that “we need to end contract policing”. In an associated poll, 39% of the people agreed with replacing the RCMP, 38% opposed and 23% were undecided.

Further along this year we have witnessed the Portapique inquiry, which showed that the managers of H Division, at the senior levels were in-fighting with their municipal agencies. Lynch and Mitchell also believed that the Emergencies Act inquiry in the end “portrays an indecisive federal police force”. It demonstrated that the very top of the organization is fraught with miscommunication and that they have become a fully integrated “political” police force, more interested in playing the political game than the operational game. Again, none of these latest revelations are good and the tarnish is not going to wear off soon.

On a lower level, when it comes to the more basic issues and the ability to staff their contracts, I am being told that the Federal positions in British Columbia are now almost 50% vacant, while the other Provincial units are approaching 30% vacancy rates. There is a lack of recruitment and the RCMP is now having trouble enticing anyone to a career and therefore an inability to staff positions. This is not new, this organization has been failing in this regard for many many years. As a result ideas are being floated in British Columbia, Alberta and parts of Saskatchewan for leaving the RCMP contracts altogether.

The Eby government has now had to provide an additional $230 million to the RCMP to assist in “fully staffing” rural policing as part of his “Safer Communities Act Plan”. This would seem to go to the very heart of the issue of not being able to fulfill the current contract.

It is also impossible to argue that the RCMP is any “cheaper” than a municipal police force, as it is a myth that the 10% discount given to the RCMP is a game changer. This is wholly swallowed up with the extra manpower demands which come about due to Federal commitments at a cost to the municipal and provincial policing needs.

There is historic irony. The British Columbia Provincial Police were disbanded on August 15, 1950, a move that was made for two primary reasons. One, was the hope that by doing so, if they brought in the RCMP they wouldn’t unionize; and secondly, they wanted to put a better fight against Communism. It would seem that on both of those issues the fight is over.

The current structure of the RCMP is damaged, in need of severe repairs. As a retired RCMP who preferred contract and the criminal work over the Federal, it is indeed bittersweet to watch the current machinations in Surrey. It is difficult to watch the demise of the RCMP in its present form, but if you don’t think it is happening you are not watching. The organization will not disappear, but I suspect we will not recognize it 20 years from now. It was good while it lasted, but policing is evolving, the past is the past and evolution is necessary to keep up with the quickly changing times. In Surrey, there is a futile attempt underway to argue that all would be good if one were to return to the RCMP. But it is a dishonest argument.

Who knows or would even dare to guess where this group of politicians will lead us. If the government gives in to the misguided sentiment of Brenda Locke and her cohorts, the only known thing for sure that the Surrey taxpayers are going to be on the hook for a rather imposing tax bill. All to return to an organization whose time is now completely taken up in plugging the holes, trying to hold back the flood waters against structural and inevitable change.

Going Gently into the Homicide Night…

On the now widely circulated dash cam footage, on a clear sunny day near the Vancouver International Airport, a black Honda Pilot flies through an intersection, a witness recording the chase excitedly exclaiming that there was a shot fired. A few seconds later, the police car slowly drifts up into the camera angle, to the same intersection, slowly coasting to a stop. A fitting metaphor to the ponderous decline of the abilities of new age policing. The gentler, kinder, softer police up against a rash of gang related homicides which are now plaguing the lower mainland of British Columbia.   

As maddening as it was to watch a police officer give up on a pursuit of these brazen suspects, who had a few seconds before, emptied a clip into Karman Grewal— no apparent inner rage on the part of the officer at having been shot at— it was even more frustrating to watch the spin of the executives of the police brass as they scramble to make the old failed attempts at gang intervention and containment look new. 

One should disregard the ridiculous often asinine media commentary of the last number of days with their simplistic pronouncements and their exclamations of how the police need to do more. The police executive are 21st century conditioned now though, to  always respond to the media inanities, no matter how futile the exercise, while at the same time only capable of trotting out the usual 20th century bromides.  

Spokesperson for the responding Integrated Homicide Team Sgt Frank Jang, in a presser at the Airport, implores those misunderstood gangsters to “Please don’t kill one another”.  In feigned disbelief he laments and states the obvious, that these incorrigibles “are putting us all in jeopardy”. 

Other police responses are equally predictable. “More visible police presence” exclaims the new CFSEU head, Assistant Commissioner Manny Mann, who explains that there are “more gangs than there were 11 years ago” . Don’t fret he says, they are going to counter with ”intelligence led policing”.  

Assistant Commissioner Dwayne McDonald, now head of Federal, Investigative Services and Organized Crime (FISOC) assures the public that the police are “working around the clock” to solve the 10 shootings since April. 

Solicitor General Mike Farnsworth had a meeting with all the LMD police executives wherein they “share their collected and unified strategies”. Assuring all that will listen, that there was an “intelligence led enforcement under way” and that they were engaged in “proactive enforcement”. This is followed by the obligatory “your safety is our number one priority”. The subsequent police press release from this meeting signed by all the Chiefs assured us that they will “not waver in our relentless pursuit to prevent, suppress and investigate”. (They should have sent that memo to the police officer in Richmond— at least the part about the relentless pursuit.) 

Over the last number of years as policing transitioned to social work, there was the singular  solution to this mess. Sociological bandages all coming from a friendlier, more understanding and diverse police departments, all playing on the theme of prevention. The need to stop these kids from entering the gangs in the first place was the stated belief. 

“Stop Now and Plan” (SNAP), “Multi-Agency School Support Team” (MAAST-Calgary), “Wraparound”, then “High Fidelity Wraparound” which was “a complex, multi-faceted intervention strategy aimed at youth crime and gang prevention”. “Youth at Risk Development” (YARD- Calgary) “Positive Attention to Youth Gangs” (PAYG), “Regina Anti-Gang Services Project” (RAGS). And in Abbotsford in 2013 the “In it Together” campaign.  

The latest academic treatise which has been making the rounds;  the Irving Spergel Comprehensive Gang Prevention Model (Dr. Spergel is from the University of Chicago). 

None of the above programs could ever be proven to be effective, so they proffer up anecdotal evidence of a young person turning the corner. It should be considered  irrelevant to the gang homicide discussion. No program ever admits defeat however, but if they do it is almost always blamed on a lack of funding or “limited police capacity”. By the way Sgt Jang is now asking parents to report on their kids which is probably not in the spirit of the afore mentioned programs. 

Other most recent solutions include the Vancouver City Police have putting out a poster with several persons they describe as being at “risk”, people you shouldn’t be around. Presumably these are aimed at people who already hang around the chain wearing Mercedes driving bad guys, directing them to run the other way and maybe call CrimeStoppers and see if you can get a reward for their efforts. One has to also wonder the criteria for selection for this recent imitation of a wild west “Wanted” poster, but you can be rest assured that the individuals chosen will see this as a medal and not a blemish on their budding Scarface careers. 

The Delta PD, for their part have recently introduced an “interdiction” team, rather than a target team. When in doubt, change the name. 

The National Police Federation in one of the silliest statements during this time, is urging the new Surrey Police Force to stop recruiting from the other departments as it is hurting in their gang fight. (This is the same NPF who has argued for the last number of months that no one is leaving the RCMP to go to this new outfit)

In 2014 CFSEU was bragging about how their hard work had led to a reduction in gang homicide. So in 2021 should we conclude that they haven’t been working as hard?  Of course not, there are a lot of hard working, albeit frustrated officers running from pillar to post, trying to patch a case together despite all the significant hurdles. 

If one wants to seriously counter some of the gang violence and I am not sure they do, then you must look at and dissect the issues that are impairing the police at this time. 

There are three parts to every homicide, gang related or not. There is the finding and arrest of the suspect;  putting the case together to get charge approval; and, finally leading it through the Courts. 

Unfortunately, while policing has been strapping on body cams to defend against all arrests being racist, these three stages have developed significant barriers to combatting gang related violence. These hurdles have been growing for a number of years in size and scope and this sorry state of affairs has been brought about by senior police managers, the Crown and the Judicial court system. 

Almost all gang related homicides are solved on two fronts. Simply put, by uniform officers working in the patrol cars— and by informants. “Intelligence led policing” would be in a very distant third place. Any significant gang arrests over the years, have been brought about by attentive policing on the street level and by gangsters turning on themselves. 

So to significantly combat the gangs, more uniform officers are needed and they need to be fully supported. They need to be engaged in pro-active checks, confident in their grounds and support of their supervisors and managers. They need to once again gain control “of the streets”  to the point where the gangsters are fearful of being checked with a gun in the car or breaching their probation and parole curfews. This has to be accompanied by a strong physical presence.The managers like to talk about “boots on the ground” however nowhere has there been a re-structuring of the organizations to insure the uniform officer contingent is the most valued, the best staffed, and where one goes to earn those promotions. 

The need for informants. This blog has written previously about the need for “rats” so there is no need to go into it deeper at this time. But the use of informants has to be both condoned and emphasized a practise which has fallen into disrepair in this social worker age. It needs to be re-instated. Funds have to be made available for agents, rewards, and re-location. Most importantly the reporting process for this has to be heavily redacted and stream lined. The RCMP is the biggest offender in this regard and have literally through bureaucratic oversight killed (pardon the pun) the use of paid informants. 

Once the culprits are arrested, you are only part way there. To state it the most simply, Crown needs to come back to the charge approval of “beyond a reasonable doubt”and away from beyond absolute doubt which they seem to have adopted in the last number of years.

This goes hand and glove with the need to address the problems of “disclosure”. In layman’s terms, disclosure is the need for full and frank exposure of all relevant investigative material to the courts and the defence. The police and the Crown have been erring on the side of caution over the last number of years interpreting relevant to mean “all” investigative material and this in combination of digital record keeping have seen files grow in size from a couple of hundred pages to averaging over five thousand pages. It has even morphed into the warrant applications where at one time they were a few pages long to now look they were written by Tolstoy. All of it is time consuming, manpower heavy, and the vast majority of the information produced of no probative value. Cases have become so heavy in terms of disclosure that they have become mired in a state of suspension, never going forward in a timely way and running headlong into the Jordan decision, which requires timely Court proceedings. 

Finally there is a BC Court system, a court system, which has still failed to recognize that the Hells Angels are a criminal organization. 

Lets face it, B.C. is Canada’s version of California, a society highly tolerant of criminal and predatory behaviour.  The billion dollar drug industry and all the violence that comes with it is virtually ignored in this part of the country and this is simply the payback. 

Drugs are the root of the gang wars, control of the turf paramount to their money and stature. The B.C. Government continues to  turn a blind eye, whether it be drugs, the laundering of monies or the street crime on the downtown Eastside. It’s the three pillar approach the social workers and the welfare infrastructure exclaims and points to as the solution.  If any of this is to change the Judges need to be governed by the protection of the public not the welfare of the suspect. In this new age of “defunding the police” this may be the most difficult wall to climb. 

As those inside the system know, the amount of change that is needed is indeed staggering, requiring all levels of government to come together and make real court tested changes. There is a need for strong and formidable police leadership. Advancement of one’s career in policing is now attached to the ability to appease, to talk the talk of diversity and inclusion not the usurping of criminal behaviour. The police executives seem content to absorb themselves in the spin to the public, promoted by keeping the public satisfied, even if it means lying to them. 

The BC government has no problem, in this time of Covid, of directing police resources and breaching the Charter rights, to check for people going camping. A rather laughable effort to stem virus transmission, but have shown no interest in a concerted effort against the gangsters who have been recently opening fire on outside dining spots. 

The officers of IHIT and other homicide agencies are spinning their wheels, albeit making a lot of money doing it, as overtime is driving file costs in the neighbourhood of half a million dollars per file. There are 400 officers in CFSEU, 100 plus officers in IHIT, now being out gunned by teenage hoodie wearing gangsters with under nourished intelligence. It’s frustrating to them and it’s frustrating to the general public.  Prof Gordon of Simon Fraser University, never one to dodge the cameras, when asked when the gangster war will ease said, “probably when they run out of targets”. 

Unfortunately, he’s probably right.
